Terms of use

These Terms of Use (“Terms”) are a contract between you and Speedway FW LLC, doing business as Hwy 84 Motors (“Hwy 84 Motors,” “we,” “us,” or “our”), and govern your access to and use of hwy84motors.com and any related pages, forms, text-message programs, or widgets that link to these Terms (the “Site”).

By accessing or using the Site, or by submitting a form on the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

These Terms apply to the Site only. They do not take the place of a vehicle purchase agreement, a retail installment contract, a Buyer’s Guide, or any other document you sign at the dealership. If those documents conflict with these Terms on a matter that concerns a particular vehicle sale or financing, the signed deal documents control that matter.

1. Who we are

Financing and loan servicing for Hwy 84 Motors is provided by KCM Acceptance LLC.

2. Eligibility

The Site is intended for users who are at least 18 years old and who can form a binding contract under Texas law. You may not use the Site if you are under 18.

3. Informational purpose; inventory and pricing

Vehicle listings, photos, prices, mileage, equipment, history notes, and availability on the Site are published for general information and to invite you to inquire. A listing is not an offer, a guarantee that a vehicle is still in stock, or a representation that every option or condition is depicted. Vehicles are subject to prior sale. Prices may change. Tax, title, license, and documentary fees are disclosed in the manner required by Texas law at the time of sale and may not be fully itemized on every listing card.

We try to keep listings accurate. Errors occur. If a price, photograph, or description is wrong, we may correct it. We are not obligated to honor an obvious typographical or systems error. Confirm the vehicle, price, and terms in person or in a signed writing before you rely on a listing.

Pre-qualification is not a loan approval, a credit decision, or an offer of credit. All financing is subject to application, verification, and approval.

4. Acceptable use

You agree not to:

  • use the Site for any unlawful purpose;
  • submit false, stolen, or another person’s information;
  • interfere with or disrupt the Site, its servers, or its security;
  • scrape, harvest, or index the Site with an automated tool except ordinary search-engine indexing;
  • copy vehicle photos or listings for a competing commercial purpose without our written consent; or
  • attempt to probe, scan, or test the vulnerability of the Site.

We may refuse, suspend, or terminate access, delete a submission, or ignore a request that we reasonably believe violates these Terms or the law.

5. Intellectual property and content ownership

The Site and all content we provide on it - including text, graphics, logos, button icons, images, vehicle photographs, audio, video, software, and the compilation and look and feel of the Site - are owned by Hwy 84 Motors or our licensors and are protected by United States and Texas intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your personal, non-commercial use in considering a vehicle transaction with us. You receive no other license. You may not copy, frame, republish, scrape, resell, or create derivative works from Site content except as these Terms allow or as fair use or another legal exception allows.

“Hwy 84 Motors” and our logos are identifiers of our dealership. You may not use them without our prior written consent.

If you submit content to us through the Site (for example, a message, a trade-in photograph, or a vehicle description), you keep whatever ownership you have in that content. You grant Hwy 84 Motors a non-exclusive, worldwide, royalty-free license to use, store, reproduce, and display that content for the purpose of responding to you, evaluating a vehicle, operating the Site, and meeting legal duties. You represent that you have the right to grant that license and that your content does not infringe anyone else’s rights.

6. Third-party services and links

The Site may link to maps, finance-application vendors, credit bureaus, manufacturer sites, or other third parties. Those services are not under our control. Their terms and privacy practices govern your use of them. We are not responsible for their content or practices.

7. Privacy

Our collection and use of personal information is described in our Privacy Policy and, for financing information, in our Financial Privacy Notice. Those documents are part of the relationship created by your use of the Site.

8. Text messaging (SMS) terms

Hwy 84 Motors sends text messages to customers who opt in on our contact form. This includes non-marketing messages about your request, such as replies about a vehicle, an appointment, or your financing, and, if you separately opt in, marketing messages such as specials and new arrivals. 9. Disclaimer of warranties

THE SITE AND ALL CONTENT, LISTINGS, TOOLS, AND SERVICES MADE AVAILABLE THROUGH THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS; THAT LISTINGS, PRICES, PHOTOGRAPHS, OR DESCRIPTIONS ARE COMPLETE, CURRENT, OR ACCURATE; OR THAT ANY PARTICULAR VEHICLE WILL REMAIN AVAILABLE AT THE LISTED PRICE.

NOTHING IN THESE TERMS DISCLAIMS A WARRANTY THAT TEXAS LAW DOES NOT ALLOW US TO DISCLAIM. NOTHING IN THESE TERMS CHANGES A WRITTEN WARRANTY, A BUYER’S GUIDE, OR AN “AS-IS” DISCLOSURE THAT APPLIES TO A PARTICULAR VEHICLE YOU BUY FROM US. THOSE DOCUMENTS CONTROL THE VEHICLE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW, HWY 84 MOTORS AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100.00) OR THE AMOUNT YOU PAID US, IF ANY, TO USE THE SITE IN THE TWELVE MONTHS BEFORE THE CLAIM.

THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT TEXAS LAW DOES NOT ALLOW TO BE LIMITED, INCLUDING LIABILITY FOR OUR OWN GROSS NEGLIGENCE OR WILLFUL MISCONDUCT TO THE EXTENT THAT LIMITATION IS UNENFORCEABLE, OR TO ANY CLAIM THAT CANNOT BE LIMITED UNDER THE TEXAS DECEPTIVE TRADE PRACTICES-CONSUMER PROTECTION ACT. THEY ALSO DO NOT LIMIT REMEDIES THAT APPLY TO A VEHICLE YOU PURCHASE UNDER A SIGNED PURCHASE CONTRACT.

11. Indemnity

You will defend, indemnify, and hold harmless Hwy 84 Motors and its owners, officers, employees, and agents from and against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site, your violation of these Terms, or your infringement of another person’s rights, except to the extent caused by our own gross negligence or willful misconduct.

12. Governing law and venue

These Terms and any dispute arising out of or related to these Terms or the Site are governed by the laws of the State of Texas, without regard to conflict-of-laws rules that would require the law of another jurisdiction to apply.

You and Hwy 84 Motors agree that the exclusive venue for any dispute arising out of or related to these Terms or the Site is the state courts located in Taylor County, Texas, or the United States District Court for the Northern District of Texas, Abilene Division, and each party consents to personal jurisdiction there. This venue clause applies to website disputes. It does not change a venue or forum clause in a retail installment contract or other signed deal document.

13. Miscellaneous

If a court of competent jurisdiction finds any provision of these Terms unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them in connection with a sale of the dealership or its assets. These Terms, together with the Privacy Policy and any click-accepted form language, are the entire agreement between you and us about the Site and supersede prior discussions about the Site.

We may update these Terms by posting a revised version on the Site with a new effective date. The revised Terms apply to your use of the Site after they are posted. If you do not agree, stop using the Site.
